LJUBIMAC d.o.o., with its registered address at Potok 43, Makarska, Croatia, operating the pet accessory e-commerce platform www.ljubimacpet.com (referred to collectively as the “Site” in this agreement), provides its customer support services via contact email wdpfm@ljubimacpet.com and telephone number +385 99 442 2072. Throughout this Terms of Service agreement, the terms “we”, “us”, and “our” refer exclusively to LJUBIMAC d.o.o., while “you”, “your”, “user”, and “customer” refer to any individual or legal entity that accesses, browses, creates an account, submits information, or completes any purchase activity on our Site.

These Terms of Service constitute a legally binding, formal contract between you and LJUBIMAC d.o.o. that governs all your interactions, activities, and transactions on our Site. By accessing our website and/or purchasing any of our handpicked pet products, you acknowledge that you have read, fully understood, and unconditionally agreed to be bound by every provision laid out in this document. This agreement applies to every category of user that visits our platform, including casual browsers, registered customers, third-party merchants operating on our marketplace, content contributors who submit product reviews, and all other visitors. If you do not accept all the clauses stated in these Terms of Service, you must immediately cease all access to the Site and refrain from making any purchases through our platform.

2. User Eligibility and Account Registration Rules

To create a registered user account on our Site and complete purchase activities, you must meet the following clear eligibility requirements:

  • You must be at least the age of majority as defined in your country of residence. For customers based in Croatia and other EU member states, this means you must be 18 years of age or older. If you are under the legal age of majority in your jurisdiction, you may only use our Site and make purchases under the explicit supervision and permission of a parent or legal guardian, who will take full legal responsibility for all your activities on the platform and any outstanding payment obligations you incur.

You must never share your account login details with any third party, and you are solely liable for all activities, actions, and transactions that take place under your user account, whether you have personally authorized those actions or not. If you discover any unauthorized use of your account or any other security breach related to your account details, you agree to notify our customer support team immediately via our official contact email, so we can take timely measures to secure your account and prevent potential loss.
  • We reserve the right to reject new account registration applications, suspend existing accounts, or permanently remove accounts in cases where users violate these Terms of Service, submit fraudulent information, or engage in activities that harm the legitimate interests of our platform or other customers.

3. Contract Formation and Order Processing Terms

Every product purchase you submit on our Site follows a standardized legally binding contract formation process fully compliant with EU e-commerce regulations:

  • When you submit an order on our Site, you are sending us a formal, binding offer to purchase the selected products listed in your shopping cart, in exchange for the stated displayed price of those products at the time you confirm your order. Before finalizing your order submission, you will be given the full opportunity to review your selected items, check all order details for accuracy, correct any input errors in your delivery address, and adjust your order contents before confirming your payment.
  • The formal purchase contract between you and LJUBIMAC d.o.o. only comes into full legal effect after we send you an official order confirmation email to your registered contact address, which clearly records the full list of ordered products, total order amount, estimated delivery window, and other relevant order details. A temporary automatic confirmation page displayed immediately after you complete payment does not constitute formal contract formation.
  • We reserve the right to reject any submitted order for legitimate reasons, including but not limited to situations where the listed product is out of stock unexpectedly, the product price displayed on the Site contains an obvious unforeseen error that is materially different from the normal market value of the product, our system detects fraudulent transaction risk associated with the order, or we have reasonable grounds to believe that the order is being placed for illegal resale purposes that violate our sales policies. If we cancel your order after you have completed payment, we will process a full 100% refund to your original payment method within 7 working days, with no additional fees or deductions applied.
  • All information, product descriptions, and usage guides published on our Site are for general reference only. We make every effort to ensure all details are accurate, but minor text, typographical, or photographic errors do not constitute valid grounds for claiming breach of contract, as long as the core functions and quality of the delivered product are consistent with the normal expected performance of that product category.

4. Payment Terms and Pricing Rules

All product prices displayed on our Site are denominated in Croatian Kuna (HRK) by default, unless you voluntarily switch your selected display currency to other supported EU currencies using the built-in currency selector on our website. All listed product prices include the applicable standard value-added tax (VAT) rate required by Croatian national law, but do not include shipping fees and optional service surcharges, which will be clearly calculated and presented to you separately on the checkout page before you confirm your order.

  • Product prices on our Site may change at any time without prior notice, and the price that applies to your order is the exact price displayed on the product detail page at the moment you submit your final order confirmation.
  • Supported payment methods include VISA, VISA Electron, MasterCard, and all other valid online banking solutions that are marked as supported on our checkout page. All payment processing activities are completed through a fully secure, PCI DSS compliant encrypted payment gateway. We do not store any complete visible card details on our own local servers, to ensure the maximum security of your payment information.
  • After your payment is successfully verified, you will automatically receive an electronic confirmation email that contains all your order details and payment records. No unauthorized post-order extra charges will ever be added to your settled order amount after you complete payment, unless you voluntarily request additional paid services such as expedited shipping after order submission.
  • You agree to bear full responsibility for any applicable additional taxes, customs duties, or import processing fees that may arise if you request delivery of your ordered products to locations outside of the current shipping coverage of our platform, and all costs generated in this scenario will be stated clearly to you in advance before we dispatch your parcel.

5. Intellectual Property Rights Rules

All content published on www.ljubimacpet.com, including but not limited to all original text descriptions of pet products, product photography, graphic designs, brand logos, page layout code, copywriting of our pet care guides, and all other visual and textual materials on the Site, is the exclusive intellectual property of LJUBIMAC d.o.o. or our authorized content licensors, and is fully protected by applicable EU copyright, trademark, and other intellectual property laws.

  • You are not permitted to reproduce, copy, redistribute, modify, publicly display, upload to other third-party platforms for commercial use, or extract large batches of content from our Site for any commercial or non-personal purpose, without our explicit prior written approval.
  • Submitting a legitimate product review on our Site that shares your real usage experience with our pet products is encouraged and permitted, and by submitting such content you automatically grant us a non-exclusive, royalty-free, perpetual right to display, modify, and republish your review content on our official website and our official social media accounts for promotional purposes. If you wish to request that we remove your submitted review content, you may contact our customer support team to make that request at any time.
  • You may not use our brand name LJUBIMAC d.o.o., our website domain name, or any of our registered trademarks associated with our pet product line, without our separate formal written authorization, to create third-party e-commerce stores, misleading promotional content, or other activities that may cause confusion among customers and imply an unauthorized association with our platform.

6. User Conduct and Prohibited Activities

When accessing and using our Site, you agree to strictly abide by all applicable local, national, and EU-level laws and regulations, and you will not engage in any of the following prohibited activities:

  • Hacking, unauthorized crawling, scraping, or launching any technical attacks against our platform servers, including using automated programs to harvest user information, disrupt our normal website operation, or bypass our website security protection systems.
  • Posting or transmitting any malicious, harmful, defamatory, discriminatory, pornographic, or illegal content in product reviews, our public comment sections, or customer service communication channels that violates public order and good morals, or infringes on the legitimate rights and reputations of other users, our staff, or any third party.
  • Placing fraudulent orders, submitting fake payment records, or engaging in abusive return and refund fraud activities, including submitting repeated false quality claims to obtain unpermitted “refund only” compensation that violates our official Returns and Refunds Policy.
  • Reselling our purchased pet products under false brand identities, or tampering with our original product packaging and reselling them as your own manufactured goods to mislead other consumers.
  • Using our platform for any money laundering, illegal fund transfer, or other criminal activities that violate applicable national and international laws.
    If we detect that you have engaged in any of the above prohibited activities, we reserve the right to immediately restrict your access to the Site, permanently terminate your user account, refuse to process any of your pending and future orders, and preserve relevant evidence to pursue further legal liability when necessary.

7. Third Party Links and Third-Party Merchant Clauses

Our Site may occasionally contain embedded hyperlinks that direct to other third-party websites, such as recommended external pet care knowledge resources, official brand websites of our product suppliers, or partner pet community platforms. We do not exercise any control over the content, privacy protection policies, or operation practices of these external third-party websites. You acknowledge and agree that we are not responsible for the accuracy, legality, or security of any content published on these external third-party platforms, and any browsing and transaction activities you conduct on these third-party websites are completely at your own risk.
For independent third-party pet goods merchants that operate product listing pages on our marketplace, we conduct pre-approval qualification checks for all merchant applicants before granting them sales access on the platform. However, we do not own inventory, directly manufacture, or take full operational control of products sold by these independent third-party merchants, and we do not assume unlimited liability for potential issues related to these third-party products beyond the scope of platform supervision responsibilities required by EU consumer protection laws.

8. Limitation of Liability

Within the maximum permitted scope allowed by applicable EU consumer protection laws, LJUBIMAC d.o.o. shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or the products you purchased from us, including but not limited to lost profits, lost business revenue, unnecessary travel expenses, or emotional distress losses, except in cases where such damage is directly caused by our proven gross negligence or intentional misconduct.
In no event shall our total aggregate maximum compensation liability amount for any dispute scenario exceed the total actual order amount you paid to us for the specific order that gives rise to the claim. Nothing stated in this clause is intended to exclude or restrict any of your non-waivable legal consumer rights that cannot be legally excluded under mandatory provisions of Croatian national law and EU GDPR regulations.

9. Policy Updates and Dispute Resolution

We reserve the right to review, adjust, and update these Terms of Service on a periodic basis to align with new regulatory requirements and operational adjustments to our platform services. When we make material changes to the core clauses of this agreement that impact your legal rights, we will publish a prominent notification on the homepage of our Site and send a notice to your registered contact email no less than 15 days before the revised new Terms of Service take effect. Your continued access to our platform and placing of new orders after the effective date of the updated Terms will be regarded as your full acceptance of the revised new provisions.
Any disputes, controversies, or claims arising out of or related to these Terms of Service shall first be resolved through friendly, good faith negotiation between you and our customer support team. If the dispute cannot be resolved through negotiation within 30 calendar days, both parties agree that the exclusive jurisdiction for all legal proceedings shall be the competent local courts located in the city of Makarska, Croatia. The entire legal relationship between you and LJUBIMAC d.o.o. established under this Terms of Service agreement shall be governed and interpreted in accordance with the substantive laws of the Republic of Croatia and applicable EU legal provisions.
